Mental Capacity is a term used to describe a person’s ability to make decisions for themselves and be able to understand what those decisions will mean for them. The Mental Capacity Act is designed to protect and empower those who may lack capacity to make decisions about their care and/or treatment. It sets out ways people can plan for a time when they are no longer able to make decisions. Deprivation of Liberty Safeguards ensures that people are protected if they can’t consent to their care arrangements in a care home or hospital and they are deprived of their liberty.
